Terms of Use

These terms are the agreement between you and Progress Over Passion LLC (“we”, “us”) for use of the Progress Over Passion iOS app. By creating an account or using the app, you accept them. If you do not agree, do not use the app.

1. Who may use the app

You must be at least 13 years old, and old enough to enter a binding contract where you live, or have a parent or guardian’s consent. You are responsible for everything that happens under your account, so keep your password to yourself and tell us promptly if you think someone else has it.

2. Accounts and invite codes

Client accounts are created by redeeming a coach’s invite code. Each code works once. Coach accounts are provisioned by us directly and cannot be created from inside the app.

You agree to give accurate information when signing up and to keep it current. We may suspend or close an account that violates these terms.

3. The coaching relationship

When you join using a coach’s invite code, that coach can see the training data you log and can assign you workouts, check-ins, and tasks. You can read the detail of this in our Privacy Policy.

Your coach is not employed by us. We provide the software; the coaching itself, and any advice or programming in it, is between you and your coach. We are not responsible for the quality, safety, or suitability of that advice.

Not medical advice. Progress Over Passion is a fitness and habit-tracking tool. Nothing in it — including workouts, nutrition estimates, calorie and macronutrient figures, weight trends, or anything your coach sends you — is medical advice, diagnosis, or treatment, and none of it comes from a licensed medical professional acting in that capacity.

Consult a qualified healthcare provider before starting or changing any exercise or nutrition programme, particularly if you are pregnant, have an eating disorder or a history of one, or have any injury or medical condition. Exercise carries a risk of injury, and you take that risk on yourself. If you feel unwell while training, stop and seek medical help.

4. Nutrition estimates are estimates

The meal-photo feature uses an automated system to estimate the nutritional content of a photographed meal. These figures are approximations and are frequently wrong to some degree. Do not rely on them for medical purposes, for managing a condition such as diabetes, or for anything where accuracy actually matters. Always check labels and ingredients yourself.

5. Acceptable use

Don’t:

Upload anything unlawful, abusive, harassing, or that depicts a minor inappropriately
Upload photographs of another person without their permission
Try to access another user’s account or data, or probe, scan, or test the security of the service
Interfere with or disrupt the service, or place unreasonable load on it through automated means
Reverse engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law
Resell, sublicense, or commercially exploit the service without our written permission

6. Your content

You keep ownership of everything you put into the app — your photos, logs, and notes remain yours.

You grant us a limited licence to store, process, and display that content strictly for the purpose of operating the service for you and showing it to the coach you are linked to. We claim no other rights over it. This licence ends when you delete the content or your account, subject to backups cycling out on a rolling basis.

You are responsible for the content you upload and confirm you have the right to upload it.

7. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in line with the App Store Terms of Service. We reserve all rights not expressly granted.

8. Availability and changes

We may change, suspend, or discontinue any part of the service at any time. We may add or remove features, and we may impose limits on storage or usage. We aim to keep the service running but do not guarantee it will be uninterrupted or error-free.

9. Ending your use

You may stop using the app at any time and delete your account from the Profile screen. Deletion is permanent and removes your data as described in the Privacy Policy.

We may suspend or terminate your access if you breach these terms, or if we discontinue the service.

10. Disclaimers

To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will meet your requirements, that it will be accurate, or that any results you seek will be achieved.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the app.

Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars (US$100).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here limits liability for death or personal injury caused by negligence, or for fraud, where the law does not permit that limitation.

12. Apple

These terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts located there, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.

14. Changes to these terms

We may update these terms. If we make material changes we will update the date at the top of this page and notify you in the app. Continuing to use the app after a change means you accept the revised terms.
